Terms & Conditions
Effective October 14, 2026 · Landmark Digital LLC
The rules for using this site and buying our services, in plain language.
About these terms
These Terms & Conditions (“Terms”) apply to your use of landmarkdigi.com and its related pages (the “Site”) and to the digital marketing services described on the Site, including website design and development, search engine optimization, social media management, reputation and listings management, AI search visibility and related services (the “Services”). The Site and Services are provided by Landmark Digital LLC (“Landmark Digital,” “we,” “us” or “our”).
By using the Site or purchasing Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use them.
Who can use the Site and Services
The Site and Services are intended for businesses and adults aged 18 or older. If you use the Site or buy Services on behalf of a business, you confirm that you're authorized to act for that business and to bind it to these Terms and any service agreement.
Using the Site
You may use the Site for lawful, personal or business purposes. You agree not to:
- interfere with, overload or disrupt the Site or the networks it relies on;
- use automated tools to scrape, copy or harvest content from the Site, except as normal search engines do;
- introduce viruses or other harmful code;
- misrepresent who you are or who you work for when contacting us;
- use the Site to break any law or infringe anyone's rights.
We may suspend or restrict access to the Site at any time, for example for maintenance or if we believe these Terms have been broken.
Information on the Site
We work to keep information accurate and current, but prices, package contents, timelines, examples and availability can change without notice. Information on the Site is provided for general guidance and isn't professional, legal or financial advice.
Results described on the Site — such as rankings, bookings, reviews or follower growth achieved for other clients — are examples from specific engagements. They aren't a promise that your business will see the same results. Marketing outcomes depend on your market, competition, budget, product and many factors outside our control.
Inquiries, quotes and agreements
Nothing on the Site is an offer to provide Services. Package pricing, inclusions and timelines described on the Site are a starting point and are confirmed in a written proposal, order confirmation or service agreement (each an “Agreement”). If anything on the Site conflicts with an Agreement, the Agreement controls.
Prices shown are in US dollars and exclude applicable taxes unless stated otherwise. Advertising spend paid to platforms such as Google, Meta or TikTok is separate from our fees and is billed to your own advertising account. We may change published prices at any time; changes don't affect an Agreement you've already signed.
Monthly plans, billing and cancellation
What you're buying. A monthly plan (for example Launch, Grow or Scale, or a stand-alone service) buys the services listed in your Agreement for the business and locations named in it, at the monthly price shown.
Payment. Monthly plans are billed in advance each month by card or ACH through our payment processor (currently Stripe), or by invoice where agreed. By starting a plan, you authorize us to charge your payment method each month until the plan ends. Work may be paused if a payment is more than 10 days late.
Initial term. Monthly plans have an initial term of three months, because search, social and reputation work needs time to show results. After the initial term, the plan continues month to month.
Cancelling. After the initial term, either of us may cancel a monthly plan with 30 days' written notice by email to sales@landmarkdigi.com. Cancellation takes effect at the end of the period you've already paid for. Except as described in these Terms or required by law, payments are non-refundable and we don't give partial refunds for unused time.
Changes to a plan. You can upgrade at any time; the new price applies from your next billing date. Downgrades take effect at the end of the current month.
Website projects
Scope and deposit. Website projects are quoted as a fixed price for the scope in the proposal. A 50% deposit is due before design starts, and the balance is due before the site goes live. Work outside the agreed scope is quoted separately before we do it.
Your part. Projects depend on you providing content, feedback, approvals and access on time. If a project is paused for more than 30 days because we're waiting on you, we may invoice the balance for work completed and resume when you're ready.
Revisions and approval. Each project includes the rounds of revision stated in the proposal. Your written approval (including by email) of a design or a page means it's accepted.
Ownership. Once the project is paid in full, you own the website, its content and the design files we created for it. Third-party themes, plugins, fonts, stock images and software stay under their own licenses. Our tools, frameworks and know-how remain ours, and we may reuse general techniques on other projects.
Hosting and care. Hosting, domains and software licenses are in your name and billed by their providers unless an Agreement says otherwise. Our optional website care plan covers updates, backups, security monitoring and small edits as described in the plan; it isn't a guarantee against outages, attacks or data loss.
Accounts and access you give us
To deliver Services you may give us access to your website, hosting, Google Business Profile, social media accounts, advertising accounts, review platforms and analytics. You confirm you're entitled to grant that access. We'll use it only to deliver the Services, keep credentials confidential, and recommend that you grant access through each platform's manager or team features rather than sharing passwords. Accounts stay in your name; when an engagement ends we'll remove our access and hand back administrative control of anything we set up for you.
Reviews, social media and third-party platforms
The Services depend on platforms we don't control, including Google, Apple, Bing, Yelp, Meta, TikTok, LinkedIn and AI search engines. Those platforms change their rules, rankings, features and availability without notice, and may suspend accounts or remove content. We follow their published guidelines — for example, we don't buy reviews, post fake reviews or ask only happy customers for them — and we can't guarantee any ranking, placement, review outcome, follower count or engagement level.
Reviews and social posts we publish on your behalf are based on information you provide and approve. You're responsible for the accuracy and legality of claims about your business, products, prices and offers.
Content you send us
If you send us text, logos, images, video, URLs, customer lists or other materials (“Your Content”), you confirm that you own it or have permission to use it, that it's accurate, and that it doesn't infringe anyone's rights or break any law. You give us a non-exclusive, royalty-free license to use, copy, adapt, publish and display Your Content to deliver the Services and to show the work in our portfolio unless you ask us in writing not to.
Content we create for you (designs, copy, posts, graphics, video edits) becomes yours when the related fees are paid. We may decline or remove any content that we consider misleading, unlawful or inconsistent with a platform's rules.
Intellectual property
The Site and the Landmark Digital name, logo and designs are owned by Landmark Digital LLC or its licensors and are protected by intellectual property laws. You may view and print pages of the Site for your own reference. You may not copy, modify, distribute, sell or create derivative works from them without our written permission. Client names, logos and trademarks belong to their respective owners.
Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for the engagement, except where disclosure is required by law. This includes your customer data, pricing and plans, and our proposals, processes and reports.
Disclaimers
The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Site will be uninterrupted or error-free, or that any Service will produce a particular ranking, traffic, review, sales or revenue result.
Limitation of liability
To the fullest extent permitted by law, Landmark Digital LLC and its owners, employees, contractors and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of, or inability to use, the Site or Services, or from the acts of any third-party platform, even if we were told such damages were possible.
Our total liability for any claim relating to the Site or Services is limited to the fees you paid us in the three months before the claim arose, or one hundred US dollars (US$100) if you haven't paid any fees. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to defend, indemnify and hold harmless Landmark Digital LLC and its owners, employees, contractors and partners from any claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or Services, Your Content, claims you make about your business, or your breach of these Terms or an Agreement.
Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site or the Services will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days.
Changes to these terms
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page. Your continued use of the Site or Services after an update means you accept the revised Terms. Changes don't alter an Agreement already in force unless you agree to them.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms isn't a waiver. You may not transfer your rights under these Terms; we may transfer ours, for example as part of a merger or sale of the business. These Terms, together with the Privacy Policy and any Agreement with us, are the entire agreement about their subject.
